GS Terms and Conditions
In using this website, you are deemed to have read and agreed to the following terms and conditions. Read the Terms and Conditions carefully before placing any order on www.gossipstore.ch.The following terminology applies to the Terms and Conditions and other official pages of the website and any or all agreements: “client”, “customer, “you” and “your” refers to you, the person accessing this website and accepting the company’s terms and conditions. “The company”, “Gossip Store”, “GS”, “we”, “us”, “website”, “site”, “ourselves” refers to our company, Gossip Store, a sole proprietorship company located in Switzerland.
General
The Terms and Conditions are subject to change. Make sure to read the current Terms and Conditions and check back often. If you do not agree with the Terms and Conditions and/or the changes, you must stop using the website immediately. No changes will take place retroactively, unless required by law.
Sales Contract
Orders placed by you on our website for the products offered by us though our website ae only an offer to conclude a sales contract. The sales contract is entered into upon the confirmation of the order by email from GS to you. This is, however, not an acceptance of your order. The acceptance of your order is when an email informing you that the purchase’s been dispatched to you has been received by you.
You are the individual or individuals placing the order. You must be 16 years old or over to enter into contact with us. By placing an order with us, you confirm being 16 years old or over.
If you are under 16 years old, you must let your parent or guardian know about the GS policy before placing an order. If you are under 16 years old, you agree that you have obtained the bill payer’s permission to enter into a contract with GS.
This contract is between you and us. No other person shall have any right to enforce any of its terms. Neither party will need to get the agreement to any other person in order to end the contract or make any changes to these terms.
Orders & Payment
When placing an order, you will be requested to provide information about yourself that is true, accurate, current, and complete to the best of your knowledge. Should any of the information change after the order has been made and before it’s been dispatched, immediately contact us.
You will also be required to provide payment details that you represent, and warrant are both valid and correct and you confirm that you are the person referred to in the billing information provided. Any credit card used for payment must be in the name of the person ordering.
The Gossip Store website is available only to those who meet Gossip Store’s terms of eligibility, who have been issued a valid credit/debit card by a bank accepted by GS, whose applications are acceptable to GS and who have authorized GS to process a charge or charges on their credit/debit card in the amount of the total purchase for the merchandise which they purchase.
GS also accepts bank transfers and TWINT payments for Swiss clients. If payment via bank transfer’s been selected, the client must ensure that GS will receive the full amount on our account. The items purchased will be dispatched only after the receipt of the full amount. The goods will be reserved for the clients who have chosen bank transfer as payment for 3 days. Afterwards, the items will be republished on the website for sale.
If an item is out of stock and you pre-order it, you will be requested to pay 100% of the total amount. When pre-ordering a handmade item, note that the form and color of the beads, as well as the form and color and design of the pendants are subject to availability. It is important to note that it takes approximately 7 days to recreate a simple design. It takes approximately 14 days to recreate a difficult design. It will take longer if the designer already has multiple orders before yours. This will be communicated to you via email once the order’s been placed.
Products purchased by the buyer are for personal or gift use and should not be re-sold, used for commercial purposes or any other commercial benefit. GS reserves the right to restrict multiple quantities of an item from being shipped to any one customer or postal address.
By making an offer to purchase merchandise, you explicitly authorize us to use your personal information provided by you in order to conduct anti-fraud checks. Personal information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.
All orders are subject to acceptance and availability. Items in your cart are not reserved and may be purchased by other customers. GS offers products for sale that are in stock and available for dispatch from our distribution center. If an item is out of stock, you may be given the possibility to make an advance purchase by contacting us directly. This will ensure that you receive this item in priority once the stock has been delivered to GS. Alternatively, you may choose to be notified when the item would be back in stock by registering your email on the page of a sold-out item.
Items received back in stock may be pre-allocated to customers who have made an advance purchase and those clients will receive the items in priority to customers on the waiting list or those ordering the items via the website for immediate dispatch. In case there are production problems or quality check issues identified when receiving an order into stock, we will notify the customers who’ve made advance payments within 24 hours after identification of the issue. The amount will be refunded to the original account from which the payment was made within thirty days of being notified that items have become unavailable.
If you have registered your email for notification of an item being back in stock, we will try to notify you within 48 hours. Be aware that certain products that arrive in limited quantities or are in particularly high demand will sell out during this period.
Pricing
Prices shown on the website are in CHF – Swiss Francs. All prices are inclusive of Swiss VAT.
The CHF price of an item displayed on the website at the time the order is accepted will be honored.
Prices are subject to change in response to currency exchange rates, markdowns, and other commercial factors. The price applicable to your order will be the price current at the time your order is accepted.
Customers purchasing from outside Switzerland for a country which is not Switzerland are recommended to contact their local customs authorities to determine a landed cost prior to purchase completion.
For customers whose credit/debit cards are not denominated in CHF, the final price deducted will be based on the applicable exchange rate on the day your card issuer processes the transaction.
Acceptance of Your Order
Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order. This email is not an acceptance of your order, but confirmation that we’ve received it.
Unless you cancel your order, acceptance of your order and completion of the contract between you and Gossip Store will be completed when we email you to confirm the goods have been dispatched. The sale contract is therefore concluded in Montreux, Switzerland.
We reserve the right to refuse your order in the event of, but not limited to, GS not being able to obtain authorization for payment, shipping restrictions applying to a particular item and/or a particular area, item(s) ordered being out of stock or not satisfying our quality control standards and is, therefore, withdrawn or that the customer does not meet the eligibility criteria set out within the Terms and Conditions.
We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be held liable by the customer or any third party to reason of our withdrawing any merchandise from the website whether or not that merchandise has been sold, for removing, screening, or editing any materials or content on the website, for refusing to process a transaction or unwinding or suspending any transaction after the process has begun.
We make every effort to make sure the details on the website are accurate, however it is possible for an item to be priced incorrectly on our website. If an error’s been made regarding the pricing of a customer’s order, the customer will be notified as soon as possible. We are under no obligation to fulfill an order that’s been advertised at the wrong price and reserve the right to cancel such an order whether it’s at the accepted or transit stage. If a customer orders an item at the wrong price, the customer will be notified either by phone or by email to inform them that the order has not been accepted or has been cancelled. If the payment has already been made, the amount will be refunded to the original account from which the payment arrived. If the order has already been dispatched, the amount will be refunded only after the product has been returned to us.
Payment
We accept Visa, MasterCard, AmEx, Maestro, Google Pay, Apple Pay, TWINT and bank transfer payments (IBAN: CH6900767000R50618065, BCV). All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize to GS, we will not be held liable for any delay or non-delivery.
If you choose a bank transfer payment option, you are to make the payment to the bank account stated on the order confirmation page. Make sure to include your order number, pay in CHF and make the payment on time (you have three days to make the payment), otherwise the order will be cancelled. All transaction fees are to be paid by the customer. If we do not receive the full amount, the order will not be dispatched until the whole amount is received at our end.
We take reasonable care to make our website secure. All credit/debit card transactions on our website are processed using Shopify Payments, a secure online application-
In addition, we take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence from our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide while accessing or ordering from GS.
Discount Codes
Discount codes are non-transferrable and there is no cash alternative.
The discount codes are non-cumulable, therefore cannot be used with other promotional codes or offers. If an expiry date is specified, the codes are to be redeemed by then.
Insurance & Delivery
You will own the items purchased at and from the later of the point in time when (1) we receive the payment in full, or (2) we deliver the items to you.
Swiss and international postal services we use are highly trustworthy and they do not, most of the time, collect signature when delivering the goods.
If no signature is collected, you agree to the terms and conditions and confirm that GS can leave your package(s) outside the premises at the shipping address provided by you without obtaining a signature for proof of delivery and take full responsibility for any loss or damages that may occur. The postal services we use may, on occasion, refuse to deliver a package to a shipping address, if they consider the shipping address to be unsafe.
Note that we aim to dispatch all orders within 48 hours. Delivery times appearing on the website are estimates and are used as a guide only and commence from the date of dispatch. In any event, we will deliver the goods to you within 30 days of the day on which we accept your order. GS is not to be held liable for any delays caused by the destination customs clearance processes. We are also not to be held liable for any delays caused by unforeseen events.
Order Cancellation (EU member states only)
Cancelling your order under the consumer contracts (information, cancellation, and additional charges) regulation 2013
If you are based in the EU, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (ICACRs), you have the right to cancel your order with us provided you give us written notice.
Right to cancel under the ICACRs
You have the right to cancel your order withing 14 days from the day after you (or someone you nominate, other than the courier) receives the last of the goods.
To exercise the right to cancel, you must inform us via the Contact Us form.
For orders cancelled under ICACRs, we will issue you with a full refund, including the shipping cost paid by you, upon the receipt of the goods. We may make a deduction from the refund for the loss in value for any goods supplied if the loss is the result of unnecessary handling by you.
We will refund without undue delay, and not later than (1) 14 days after the day we receive back from you any of the goods supplied, or (2) (if earlier) 14 days after the day you provide us with evidence that the goods have been returned, or (3) if no goods were supplied, 14 days after the day on which we are informed about your cancellation.
We will refund the amount using the same means of payment as you initially used to purchase the items unless you have explicitly requested otherwise. In any event, you will not incur any additional fees as a result of the refund.
In the event that we have sent goods to you and you have cancelled your order, we may withhold a refund until we have received the goods back or you have supplied sufficient in our opinion evidence of having sent the products back, whichever is earliest.
All returns are to be sent to A. Meliksetyan, Avenue des Alpes 3, 1820 Montreux, Switzerland without undue delay and, in any event, not later than 14 days from the day on which you communicate your cancellation of the contract to us. The deadline is met if you send the goods before the period of 14 days has expired.
You will have to bear the cost of returning the goods.
You are only liable for any diminished value of the goods resulting from the handling, other than what is necessary to establish the nature, characteristics and functioning of the goods.
Note that you may only use your right to cancel the order under the ICACRs if you give us a formal written notice of cancellation any time after your order has been placed, up until 14 calendar days from the day after you receive the order either by email or post.
Our Policy
Gossip Store only handles returns under the ICACRs or, for those based outside the EU, in extenuating circumstances. In either cases, a return and refund claim must be submitted by email or post office any time after the order has been placed and up to 14 calendar days from the day after you receive the order.
Items should be returned unused and with all GS tags still attached. Returns that are damaged and/or soiled will not be accepted and will be sent back to the customer and/or a refund will be refused.
If any of the orders have been delivered without the tags, contact us via the Contact Us form to inform us.
GS cannot be held liable for any wear-related or physical damage caused after the receipt of the goods by the customer. We make sure to carefully inspect the goods before shipping them. Gossip Store cannot be held liable for any damage caused by the postal service or other shipping companies.
Goods can be considered faulty if a manufacturing fault occurs within six months of purchase. Items that are damaged as a result of normal wear and tear are not considered faulty.
Care & Usage
Note that all goods are fragile and very delicate, therefore must be handled with care.
The handmade beaded handbags are not designed for daily wear. Avoid carrying heavy items for a long period of time for the bags to retain their original shape and form.
The items should not have any contact with water or any chemical products (cream, lotion, perfume, shower gel, etc.). The items should not be under prolonged exposure to the sun, as this can lead to discoloration. These instructions will ensure that you enjoy the shine and condition of the goods for as long as possible.
Colors
We have made every effort to display as accurately as possible the colors of our products that appear on Gossip Store. However, as computer, laptop, tablet, phone monitors and screens vary, we cannot guarantee that your monitor/screen’s display of any color will be completely accurate.
Intellectual Property Rights
Your use of our website and its contents grants no rights to you in relation to any copyright, designs, trademarks and all other intellectual property and material rights relating to the content (as described in the content section below), including all HTML and other code contained in this website. All such content is protected by national intellectual property and other laws and international treaty provisions. You are permitted to use the content only as explicitly authorized by GS. Any reproduction or redistribution of the content listed below is prohibited and may result in civil or criminal penalties.
Content
In addition to the intellectual property rights mentioned above, “content” is defined as any graphics, photographs, including all image rights, music, video, audio, or text on this website. We try to ensure that the information on this website is accurate and complete. We do not, however, promise that the content is error-free. We do not promise that the functional aspects of our website or content will be free of errors or that this website, the content, or the server that makes it available are free of viruses or other harmful components that we have no power over. In general, all Internet users are recommended to ensure they have up-to-date anti-virus software installed.
No Commercial Use
This website is for your personal non-commercial use only. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, data mine or sell any content, products or services contained within this website. You may not use this website, or any of its content, to further any commercial purpose, including any advertising or advertising revenue generation activity on your own website.
Your Activity
You agree that you will be personally responsible for your use of this website and for all of your communication and activity on and pursuant to this website. If we determine that you are or have been engaged in prohibited activities or otherwise violated the Terms and Conditions, we may deny you access to this website on a temporary or permanent basis.
Limits On Our Liability
We are not responsible for losses not caused by our breach or negligence, indirect losses which are a side effect of the main loss or damage and which are not reasonably foreseeable by you or GS (for instance, loss of profits or loss of opportunity).
We are not responsible for the failure to meet any of our obligations under the Terms and Conditions where such failure is due to events beyond our reasonable control.
Compensation
At our request, you agree to compensate us fully, defend us and hold us harmless immediately on demand, our officers, directors, agents, affiliates, licensors and suppliers, from and against all liabilities, claims, expenses, damages and losses, including legal fees, arising from any breach of the Terms and Conditions by you, including the use by any other person accessing the website using your IP address caused by your action or inaction.
Our Relationship
You acknowledge and agree that no joint venture, partnership, employment, or agency relationship exists between you and GS as a result of the Terms and Conditions or your use of this website. You agree that you may not and will not hold yourself out as a representative, agent, or employee of GS, and we shall not be liable for any representation, act or omission on your part.
No Waiver
If you breach the Terms and Conditions and we take no action against you, we will still be entitled to use our rights and remedies in any other situation where you breach the Terms and Conditions.
Governing Law
The Terms and Conditions together with all our policies and procedures will be governed by and construed in accordance with the Swiss law.
